These general sales conditions apply to all products offered by KONOÏ |Be Water Sàrl (hereinafter jointly referred to as “KONOÏ”) on the online store listed on the website as www.konoi.ch (named “the Site”). By placing an order online or by email, the Customer fully agrees to the following terms and conditions of the sale.
1. Product information
Each product offered on the Site is the subject of a presentation indicating its name, composition and price. The photographs and information relating to the products presented on the Site are not contractual. In case of discrepancy between these photographs and information and the product (s) chosen by the Customer, KONOÏ cannot be held responsible. KONOÏ reserves the right to modify the composition of the products, depending on the risks linked to the product supplies and/or under the precautionary principle. The products are packaged in a specific packaging ensuring compliance with the cold chain during transport from the place of manufacture to that of delivery.
2. Order process
All orders must be placed on the Site no later than 3 working days before delivery. Any order placed on the Site must be validated by the Customer. The Customer will take care to enter his contact details precisely and correctly. Validation constitutes conclusion of the sales contract. The Customer also has the possibility of placing an order by email at firstname.lastname@example.org within the same deadlines. This order will be entered on the Site by a KONOÏ collaborator, according to the Customer’s information. The latter will give the correct contact details (name of the Customer, billing and delivery address and telephone number) in order to be able to validate his order and validly conclude the sales contract. Whatever the order method used, KONOÏ will send the Customer, by email, a confirmation of the recorded order which will contain the details of the items chosen. The Customer must ensure the accuracy of the order. Any error or delay cannot be attributed to KONOÏ in the event of partial or incorrect indications.
Once the order has been confirmed, the prices are fixed. On the Site, prices are subject to change without notice. They may be revised depending on the price of seasonal products and economic conditions. In any case, a change in prices on the Site cannot be applied retroactively to an order already finalized.
If a product is unavailable, we will notify you as soon as possible when the product becomes available again.
An order can be cancelled or modified by email respecting the minimum period of 3 days before delivery. After this period, the order cannot be cancelled. Administrative costs of 20.- will be charged before refund.
6. Terms of Payment
6.1 The amount
The prices indicated on the product catalogue as well as the delivery costs are expressed in Swiss francs (CHF) and are understood to include all tax (TTC), the applicable VAT rate being that in force on the day of the order.
6.2 Payment Options
Whatever the method of payment, payments are made in Swiss francs( CHF). The Customer is required to specify his method of payment when ordering and to comply with it.
6.2.1 Payment by bank or postal transfer
Only payment by bank or postal transfer, or by Paypal / Stripe (with a Paypal account or a credit card) is accepted. Payment must be confirmed before the delivery or KONOÏ reserves the right not to deliver the order. The transfer is made either to the Customer’s bank, by e-banking or by Post with a red BVR to fill out. The red Post BVR must mention the name of the beneficiary as well as the IBAN. The Customer must inquire directly with his bank for the terms and transfer fees
6.3 The invoice
KONOÏ systematically sends an invoice by email to the Customer in accordance with its billing details.
7. DELIVERY – Frozen Dessert
Deliveries are strictly limited in the city of Geneva and Carouge within the time slot indicated on the Site. However, KONOÏ cannot guarantee that the delivery will be made within the specified time slot taking into account unforeseen traffic or other possible causes of delay. The delivery costs are invoiced to the Customer following the delivery price in force on the Site. The prices indicated on the Site include its costs.
The Customer must provide the necessary information in order to allow successful delivery of KONOÏ (e.g. building code, floor), and ensure to be present during the delivery time frame. In case the Customer is absent in the scheduled delivery slot, the delivery person will place the order at the door, in the mailbox or according to the instructions left at the end of the online order. In these cases, the products will be considered as delivered and KONOÏ reserves the right to invoice the Customer for the order. KONOÏ will not compensate or refund the Customer if the delivery has been damaged or stolen after being delivered to the place indicated by the Customer.
Once the order delivered, the Customer shall immediately place the products in a freezer under -18 degrees.
The Customer has the possibility to change the delivery address up to 72 hours before the delivery date by sending an email to email@example.com. KONOÏ reserves the right to refuse the place of delivery.
In the event of severe weather or extraordinary traffic problems, KONOÏ reserves the right to postpone deliveries without any compensation by notifying the Customer by telephone 1 hour before delivery.

8. DELIVERY – DRY GOODS
Our dry products are available in Switzerland as well as in Europe. The transport of the goods to the delivery destination is carried out at the Customer’s expense and risk. KONOÏ has set up a delivery system via the services of the Swiss Post within 2 to 4 days once the order has been placed and validated for Switzerland. For Europe, delivery is 2 to 10 days.
Customs duties, local taxes, import duties or state taxes may be due in certain cases. These duties and taxes are not the responsibility of KONOÏ. They will be borne by the Customer and are their sole responsibility (declarations, payment to the competent authorities). KONOÏ invites the Customer to inquire about these aspects from the corresponding local authorities.
9. HEALTH AND NUTRITION
If the Customer is under any medical treatment, it is advisable to consult a doctor before placing an order.
KONOÏ aims to support the Customer in pursuing balanced nutrition. However, we do not pretend to treat or cure diseases. People with serious illness should inform themselves from different sources and of course, consult their doctor. As each body is different, the information we provide cannot replace the services offered by health and nutrition professionals.

Comme nous travaAs we work in a shared kitchen, KONOÏ cannot guarantee the total absence of these allergens in our products.
KONOÏ cannot be held responsible for an allergic reaction and its consequences for a Customer consuming KONOÏ products. In case of severe allergy, KONOÏ advises Customers not to take risks. Any contrary decision by the Customer (whether intolerance or severe allergy) is taken at their risk. KONOÏ decline any responsibility as for the consequences related to this decision. KONOÏ is not suitable for the specific serious case of malnutrition such as acute obesity or anorexia and we strongly recommend the follow-up of a doctor before any order.
10.1 The delivery
Once the order is delivered, the Customer must immediately ensure the conformity of the delivered product(s) with his order. In case of non-compliance, product defect or missing products, the Customer must inform KONOÏ by email at firstname.lastname@example.org on the day of delivery. Only products damaged directly (open, torn, dented products) or questioning their freshness due to a damaged package will be taken into account.
In this case, we will make sure to remedy it by another delivery if possible or we will refund the damaged products, excluding any other compensation. For reasons of food hygiene and safety, perishable foodstuffs will not be returned or exchanged. The complaint period for any order is 3 days.
10.2 The invoice
Any problems concerning the invoicing must be notified to KONOÏ within 8 days from the date of receipt of the invoice, failing which it will be deemed to be accepted.
For any questions or additional information, the Customer is invited to contact KONOÏ either by telephone at the contact telephone number (indicated at the bottom right of the site, Monday to Friday inclusive, from 2 p.m. to 5 p.m.), or by email at email@example.com
11. Child protection
In the context of respecting the laws for the protection of youth which prohibits the sale of wine and beer to minors under 16 years of age and that of spirits, aperitifs and alcopops to young people under 18 years of age, the delivery person may require the Client to submit an ID.
12. Data protection
By validating the creation of an account, the Customer tacitly agrees to receive advertising information from KONOÏ. The Customer can unsubscribe at any time by accessing his account.KONOÏ reserves the right to use the data provided by the Customer with the utmost confidentiality, for statistical analysis purposes.
13. LIABILITY AND GUARANTEE
Unless proven faulty, KONOÏ cannot be held liable for any damage result from the use of the Site, such as, in particular, loss of data, intrusion, virus, suspension of service, fraudulent use bank card. Furthermore, KONOÏ cannot be held liable for any direct or indirect damage caused by the Customer, in particular the non-compliance with the storage conditions.
14. Force majeure
KONOÏ may be free itself from the obligations or suspend execution if it is unable to assume them following a case of force majeure (war, riot, demonstrations, exceptional weather conditions, disaster affecting the installations of its establishments, etc.), without giving rise to any compensation to the Customer.
KONOÏ reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the Customer.
The texts, photographs, images and logos appearing on the Site are the property of KONOÏ. Any reproduction, even partial, is subject to authorization.
17. Applicable law
Swiss law applies to these general conditions of sale.
If no amicable agreement has been found, any dispute arising from the interpretation or execution of the contract subject to these General Conditions of Sale will be the exclusive jurisdiction of the courts of the Canton of Geneva, subject to appeal to the federal tribunal.
